The first product policy that will affect your seller and account health is suspected intellectual property. Amazon maintains a platform geared towards the integrity of your product offerings. As a brand, it’s your responsibility to make sure your listing content does not infringe on any other brand’s intellectual property rights.

Amazon has instituted an anti counterfeiting policy. It ensures that you are a trustworthy brand and you are adhering to the following Amazon agreements. First, the sale of counterfeit products is strictly prohibited. Second, You may not sell any products that are not legal for sale, such as products that have been illegally replicated, reproduced, or manufactured.

And third, you must provide records about the authenticity of your products. If Amazon requests that documentation. As we all know by now, Amazon takes their customer experience very seriously. So failure to abide to buy this policy may result in loss of selling privileges, funds being withheld, destruction of inventory in their fulfillment centers, and other legal consequences.

Amazon has set a target for zero violations to maintain good seller health standings in order to stay within Amazon stringent policies. Here are a few tips to abide by. The first is to sell only authentic and legal products that are proprietary to your brand and that you hold a patent or trademark on.

As a brand, be sure to do your due diligence if it’s an item being sourced. Check with your lawyers to be sure it is an authentic and legal product for sale, and that it does not infringe upon others’ patents or trademarks. Sell only proprietary products that are a reflection of your brand promise and what it stands for.

Be sure to not include bootleks. Fakes or pirated copies of products or content and that products have not been illegally replicated, reproduced, or manufactured. And lastly, make sure that products do not infringe another party’s intellectual property rights. And here are some other tips. Be sure to maintain detailed records and provide inventory records upon request.

Amazon may request that you provide documentation, like invoices or certifications that show the authenticity of your products or your authorization to list them for sale. You may remove pricing information from these documents. But providing documents that have been edited in any other way or that are misleading is a violation of this policy and will lead to enforcement against your accounts.

And there are consequences of selling inauthentic products that could result in immediate suspension or a termination of your Amazon selling account and any related account. Inauthentic products that are being stored in a fulfillment centers may be immediately destroyed at your expense. And Amazon may withhold any payments owed to you.

Amazon takes this matter very seriously and will take preventive measures as well to protect their customers and rights owners. Amazon works directly with manufacturers, rights holders and content owners, vendors and sellers to improve detection of inauthentic products. With the end goal of these products, never reaching customers.

Therefore, to uphold their detection and enforcement activities, Amazon may remove suspect listing. Or take action against parties who knowingly violates this policy and harms customers. In addition to criminal fines and imprisonment, sellers and suppliers of inauthentic products may face civil penalties, including the loss of any amounts received from the sale of inauthentic products.

The damage or harm sustained by the rights holders, statutory and other damages and attorney’s fees.
